Evans Moore, LLC Facilitates a Medical Malpractice Lawsuit Following an Inmate's Wrongful Death

Georgetown, SC - Evans Moore, LLC is suing the Spartanburg County Detention Center for medical malpractice and the wrongful death of Ashley Lee Apple, who was booked on April 8, 2024. The EMS arrived at the detention center on April 12, 2024, and found Ashley unresponsive before they pronounced her dead at the hospital that afternoon. The cause of death was Acute peritonitis due to a perforated ulcer.

Moore III, strongly condemned the detention center’s negligence. “Instead of taking her complaints seriously, Ashley got an Ibuprofen and died from an illness that in modern medicine people don’t die from. When you’re in jail, and you’re 100 percent reliant on medical staff for access to care, it’s on them. Had she not been incarcerated, she could have picked up the phone and called 911. She would have been treated and she would have lived.” His statement highlights the critical responsibility of correctional facilities to ensure inmates receive proper medical attention. 

The parties involved in the litigation have 120 days from the notice of intent to meet with a mediator as required by law in medical malpractice cases. If no agreement is reached during this mandatory mediation period, the case will proceed to court.
